Terms of sale and membership
These terms apply when you buy an Attentiv Band membership from this website.
1. Who we are
This website and the Attentiv Band membership are provided by Pharmacare Ltd, a company registered in England and Wales (company number [company number]), registered office [registered address]. VAT number [VAT number]. You can contact us at info@myattentiv.co.uk.
2. What you are buying
The Attentiv Band membership includes the Attentiv Band wristband, a charger, and full access to The Focus Club app for as long as your membership is active. The band delivers reminders you set in the app as vibrations on your wrist, and records sleep, steps and resting heart rate for general wellness.
The Attentiv Band and The Focus Club app are not medical devices. They do not diagnose, treat, cure or monitor any medical condition, including ADHD, and they are not a substitute for advice from a doctor or other healthcare professional.
3. Price and payment
The membership costs £179.99 a year, including VAT, billed yearly. You can pay by card or, where offered at checkout, in instalments with Klarna. If you pay with Klarna, Klarna’s own terms also apply to that payment.
Creator codes give a discount on your first payment only. The amount depends on the code and is shown at checkout before you pay. Codes are for new customers, one code per order, and cannot be exchanged for cash or applied after you have paid.
4. Your order
When you place an order we take payment and email you a confirmation. The contract between us starts when we send that confirmation. If we cannot fulfil your order, for example because the band is out of stock, we will tell you and refund any payment in full.
5. Delivery
We deliver to UK addresses only, by free tracked delivery. We will email you tracking details when your band is sent. The band becomes yours, and is your responsibility, once it is delivered.
6. Renewal and cancelling
Your membership renews automatically each year at the price shown on our website at that time. Your price is guaranteed for your first year. We will email you at least 30 days before each renewal with the date and the amount.
You can cancel at any time from your account. Cancelling stops your next renewal: you will not be charged again, and your membership stays active until the end of the year you have paid for. Outside the 30-day money-back period described in our returns policy, we do not refund part of a year.
7. Your right to cancel and the 30-day guarantee
You have a legal right to cancel within 14 days of receiving your band. On top of that, we give you 30 days from delivery to send the band back for a full refund. See our returns policy for how this works.
8. If something goes wrong
If your band is faulty or not as described, you have rights under the Consumer Rights Act 2015, including a repair, replacement or refund. Contact us and we will put it right. Nothing in these terms affects your legal rights.
9. Using the app
Please use the app and the community features respectfully. We may suspend access to community features for anyone who harasses other members or posts unlawful content. Aydee, the AI planning assistant, can make mistakes; check anything important, and never rely on it for medical advice.
10. Our responsibility to you
We are responsible for loss or damage you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care and skill. We are not responsible for loss that was not foreseeable. We do not exclude or limit our liability where it would be unlawful to do so, including for death or personal injury caused by our negligence.
11. Changes and the law
We may update these terms. If a change affects your membership, we will tell you before it applies to your next renewal. These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you can also bring proceedings in your local courts.
Privacy policy
How we collect and use your personal data, and your rights over it.
Who is responsible for your data
Pharmacare Ltd is the data controller for the personal data described here. ICO registration number [ICO number]. Contact us about privacy at info@myattentiv.co.uk.
What we collect
- Account and order details: your name, email, delivery address, and order history. Card details are handled by our payment provider; we never see or store your full card number.
- What you put in the app: your tasks, reminders, plans and anything you share with Aydee.
- Data the band records: sleep, steps and resting heart rate.
- Website data: pages visited and, only if you accept, analytics and advertising cookies.
- Messages you send us, and details you give on our Access to Work quote form.
Health data
Sleep, heart rate and anything you tell the app about ADHD can be health data, which the law treats as special category data. We only process it to provide the app’s features to you, with your explicit consent, which you give when you set up the band. You can withdraw consent at any time by turning off the band’s recording in the app or deleting your account.
Why we use it and our lawful basis
- To take payment, deliver your band and run your membership (contract).
- To send renewal reminders and service emails (contract and legal obligation).
- To keep the service secure and fix problems (legitimate interests).
- To send marketing emails, only if you tick the opt-in box at checkout or sign up on our site (consent). Every email has an unsubscribe link, and you can withdraw consent at any time.
- To measure and improve our advertising with cookies, only if you accept them (consent).
Who we share it with
We never sell your data, and we never share your data with your employer, including through Access to Work. We use trusted service providers who process data on our behalf under contract:
- Payments: Stripe and, if you choose it, Klarna.
- AI features: requests you make to Aydee are processed by Anthropic to generate a reply.
- Email: Klaviyo, to send service emails and, only if you opt in, marketing emails.
- Hosting and delivery providers, to run the service and send your band.
- Analytics and advertising (including Meta), only if you accept those cookies.
Some providers may process data outside the UK. Where they do, we use safeguards approved under UK data protection law, such as the International Data Transfer Agreement.
How long we keep it
We keep your account data while your membership is active. If you delete your account, we delete your app and band data within 30 days. We keep order and payment records for six years because tax law requires it.
Your rights
You can ask to see, correct, export or delete your data, object to how we use it, or withdraw consent. You can export your data and delete your account from the app’s Profile tab; deletion asks you to type a confirmation so it cannot happen by accident. Or email us and we will reply within one month.
If you are unhappy with how we handle your data, you can complain to the Information Commissioner’s Office at ico.org.uk or on 0303 123 1113.
Returns and refunds
Try it for 30 days. Not for you? Send the band back for a full refund.
30-day money-back guarantee
You have 30 days from the day your band is delivered to decide. If it is not for you, email info@myattentiv.co.uk within those 30 days and send the band and charger back to us. We refund your membership payment in full, including any delivery cost, and your membership ends.
Your 14-day legal right to cancel
Separately, the Consumer Contracts Regulations give you 14 days from delivery to cancel. Our 30-day guarantee is longer and works the same way, so you can simply use that.
How to send it back
- Email us with your order number. We will reply with a free returns label.
- Pack the band and charger, in the original box if you still have it.
- Send it within 14 days of telling us you want a refund.
We refund you within 14 days of receiving the band, to the payment method you used. If you paid with Klarna, Klarna updates or cancels your remaining instalments. We may reduce a refund if the band has been damaged beyond normal handling.
After 30 days
After 30 days you can still cancel from your account at any time. Your membership stays active until the end of the year you paid for, and you will not be charged again. Faulty bands are covered by your rights under the Consumer Rights Act 2015.
